We may vary the credit limit to such sum as we may from time to time determine under the agreement. We will give you notice of any such variation in writing. Once this Agreement is in force, you can apply to us for an advance. Each time you apply, we will tell you if your application has been accepted. If you do so, we will transfer the amount of credit into your registered bank account. If we agree to advance you a different sum, we will tell you about the charges for credit which would be payable before you agree to continue with the advance.

Interest: The rate of interest applicable to this Agreement is _____ per annum fixed. Interest is calculated at the time of each advance and applied to the principal daily at a rate of _____ per day.

In calculating the APR, no account has been taken of any variation which may occur under the agreement either of the rate or amount of any item entering into that calculation. We may vary the interest rate and/or charges payable from time to time. If we do so, we will tell you about that variation before you agree to enter into any further advance.

Default Charges

If you are late in repaying an advance, we will charge you:

We will charge you a default fee of £15.00 once you miss a repayment for the first time and it has become 3 days overdue.

We will send reminder emails and text messages in relation to your upcoming repayments and reminder emails and text messages in relation to any missed payments.

We will send you a notice of default once the advance has become 4 months overdue.

Interest will be payable on any overdue sums at the rate of _____ per day on the principal once they are 1 day overdue (see clause 3.4 (d)).
We are entitled to charge you a £5.00 administration fee in addition to any charge back fee incurred (clause 3.5).
If you are approved for an extension of the Repayment Period, you must pay the interest for the days you extend the loan for.

If you have still not paid 65 days after the repayment date, the account is transferred to a debt collection agency. You have to pay any other costs that we reasonably incur as a result of you missing your payments, for example our reasonable legal costs or the additional costs incurred by a debt collection agency.
If you are late in repaying the advance we will charge you interest at the applicable interest rate for that advance on the amount of the advance until it is repaid in full.

We implement a total cost cap of 100% of the principal. This means the total amount that may become owed by you will not be more than twice the amount of the principal.

MISSING PAYMENTS

Missing payments could have severe consequences, for example, legal proceedings may be commenced against you and make obtaining credit more difficult. If you have problems with paying back any advance, please contact customer service immediately.






Termination

You have a right to terminate this agreement at any time. You may do so by giving notice in writing by sending a letter to us at Mappin House, Oxford Street, London, Greater London, W1W 8HF, United Kingdom or by sending an email to info@creditstar.co.uk. If you do so after you have received payment of an advance from us, you will be required to repay the amount of the advance plus interest at the rate stated in Other Financial Information from the date of the advance to the date of repayment by you.

Right of Withdrawal

Once we have signed this agreement, there will be a period in which you may withdraw from it without giving any reason. This period will end on the 14th calendar day, counting from the day after you receive notice that we have signed the agreement. If you wish to withdraw, you should write to Mappin House, Oxford Street, London, Greater London, W1W 8HF, United Kingdom or e-mail info@creditstar.co.uk. You will be liable to repay the amount of credit to us within 30 calendar days together with interest at the rate stated in Other Financial Information from the date that you signed this agreement until the date you repay the credit.

Statement of Account

You have the right to receive on request at any time and free of charge a statement in the form of a table showing the repayments owing under this Agreement, the periods and conditions relating to the repayments and a breakdown of each repayment between capital, interest and charges.

Early Repayment

You have the right to repay early the amount you owe under this agreement in whole or in part. If you wish to do so, please contact us via email or phone.

Complaints

All complaints will receive a response via email or letter within 5 working days of receipt of the complaint. We are authorised and regulated by the Financial Conduct Authority (FCA), which is the regulatory authority of consumer Loan Agreements, registration number 675392.

TERMS AND CONDITIONS

1. Our business

1.1 We are registered at Companies House under number 7085760. Our main business is consumer lending and we provide short-term credit facilities to customers in return for the repayment of the credit and the payment of interest. We are authorised and regulated by the FCA under registration number 675392.






2. Advances

2.1 You can make a request for an advance by:
Logging into your account at www.creditstar.co.uk. You need to sign into your account and follow the onscreen instructions to make a request. There you can select the amount and duration of the loan. You will then be provided with on screen instructions in order to request the loan. We will check your personal and financial details with Credit Reference Agencies to make sure we can approve your loan request. No advance request or offer from us is pre-approved. We make every effort to make sure whether our products are right for you. We reserve the right to refuse any request for an advance made by you if we have reason to believe fraud or reason to believe that our services are not right for you.

2.2 In the event that a request for an advance is made by you by other means, we may choose to accept this at our sole discretion.

2.3 From time to time, we may increase your credit limit. If so, your credit limit will vary to this amount. In the event that we refuse to provide you with an advance, your credit limit will be reduced to nil.

2.4 We will arrange for payments to be advanced to you by paying these sums into your personal registered bank account ("the Account").

2.5 If we agree to provide you with an advance, you must respond to us by the end of the second working day. Otherwise we are not obliged to provide you with an advance and can refuse any requests for a further advance.

2.6 From time to time, we may decide to vary the amount or rate of the charges shown on the front of this Agreement (including interest charges, transfer fees and default charges). We will provide you with seven days notice in writing if we decide to change the default charges applicable to this Agreement.
Otherwise, we will tell you about any change in the interest or the transfer fees upon receipt of a request from you for an advance. Any variation in our charges will only affect future advances and will have no effect on any advance which we have already provided to

2.7 You cannot request a further advance if you still owe us money under a previous advance (including interest and transfer fees and default charges).

3. Repayments

3.1 By signing this agreement, you confirm that your wages are regularly paid into the Bank Account you have registered with us and you agree to ensure that there are sufficient funds available in the Account on the repayment date(s) to repay any advance to us.

3.2 You authorise us to collect repayments from you using Continuous Payment Authority (CPA). If we are unable to collect the full repayment using CPA you must make us a bank transfer on the agreed date by transferring the total amount owed by you. If you wish to repay an advance before the agreed payment date, then you must make the payment on the date we have agreed. You shall inform us immediately if you wish to change the Bank Account and Card details which you have registered with us. We will not use CPA more than 2 times per instalment. Any part payment(s) that may be agreed with you will be collected using CPA only if you have given us express consent to do so. 3.3 If you wish to extend (rollover) your loan we will allow you to apply for an extension of the initial Repayment Period by 5-30 days for no more than 2 times per loan agreement. If you do so, and if the extension request is approved by us the interest of the Loan will be payable immediately by bank transfer or collected from your registered debit card. Please be aware that extending the Repayment Period may not be the best option and may have a negative effect on your financial situation.

3.4 In the event that we are unable to collect any repayment for any reason, we will:
a) Contact you via telephone or email to discuss the reason(s) for the failed repayment(s) and to discuss your financial situation and give advice on your situation and payment.
b) Send reminder emails and text messages to you, in accordance with the provisions contained in the Default Charges section of the Agreement.
c) Be entitled to charge interest on any overdue sums. Interest will begin to be charged from the 1st day, at the rate of _____ per day on the principal. From the 3rd day after your first missed payment date a default fee of £15 will be added to your outstanding balance, unless i) we have reached an agreement on a payment plan ii) have received information of an intended debt management plan. Interest will accrue at the rate of _____ per day of the principal, unless we have i) reached an agreement on a payment plan ii) have received information of an intended debt management plan iii) have referred your debt to a Debt Collection Firm.
d) Cap interest and charges at 100% meaning that the maximum amount that may become owed by You will never be more than twice the amount of the advance provided to you.

3.5 In the event that we attempt to collect any repayment from your debit card and this is rejected by your bank on the basis that the payment to us is not authorised, without you first notifying us that your details have changed in accordance with clause 3.2 above, we shall be entitled to seek payment from you of any charge back fee plus an administration fee of £5.00 in respect of each charge back fee.

3.6 You acknowledge that additional taxes, legal costs or other charges may be levied which are not payable by us or imposed by us in relation to this Agreement.

3.7 You have the right to cancel Continuous Payment Authority at any time by: i) emailing us at info@creditstar.co.uk; ii) calling 02036957544 within our opening hours; iii) instructing your bank to cancel CPA. Cancelling Continuous Payment Authority will not terminate this Agreement and you must arrange for another way to pay us

4. Termination

4.1 You have a right to terminate this agreement at any time. If you wish to do so, you must give notice in writing by sending a letter to us at Creditstar UK Limited, Mappin House, Oxford Street, London, Greater London, W1W 8HF, United Kingdom or by e-mail to info@creditstar.co.uk.

4.2 If you do so after you have received payment of an advance from us, you will be required to repay the amount of the advance plus interest at the rate stated in Other Financial Information from the date of the advance to the date of repayment by you.

5. Withdrawal

5.1 You have a right to withdraw from this Agreement within 14 days, beginning with the day after this Agreement is signed by us. You may exercise this right by giving notice in writing to Creditstar UK Limited, Mappin House, Oxford Street, London, Greater London, W1W 8HF, United Kingdom or by e-mail to info@creditstar.co.uk.

5.2 If you do so after you have received payment of an advance from us, you will be required to repay the amount of the advance plus interest at the rate stated in Other Financial Information from the date of the advance to the date of repayment by you.

5.3 If you do not exercise this right, this agreement will be binding upon you and you must repay any advance in accordance with these terms and condition

5.4 If you do not withdraw you will still be able to settle any advance prior to the repayment date. You can do this by paying the outstanding balance that is due and payable in full (including interest and charges) less any rebate which may apply under the Consumer Credit Act 1974.

5.5 Any request for an advance made by you prior to the expiry of the cancellation period shall be treated as a request to provide an advance. However, you acknowledge that we are under no obligation to make this advance.

5.6 In the event that you withdraw from this Agreement, as soon as possible and in any event within 30 calendar days from the date on which you notified us of the withdrawal:
a) We will refund any sum paid by or on behalf of you,
b) You must repay any sum paid by or on behalf of us under or in relation to this Agreement. Accordingly, we can charge you for services actually provided by us in accordance with the terms of this Agreement, including the amount of any unpaid interest and transfer fees and charges outstanding in respect of any advance.

6. General

6.1 By signing this Agreement, you confirm that you are not currently the subject of:
a) a debt management plan;
b) an Individual Voluntary Arrangement; or
c) bankruptcy proceedings.

6.2 In addition, you confirm that you are in employment and you are not:
a) Self Employed;
b) Absent from work due to sickness leave, maternity leave, paternity leave, adoption leave, or any other kind of unpaid leave;
c) Under notice of redundancy or any disciplinary action that may cause your employment to be terminated; or
d) Intending to resign from your current employment within 30 days of the date of this agreement.

6.3 You are not required to provide us with any security under the terms of this agreement.

6.4 There is no minimum term of this agreement

6.5 If we do not enforce our rights under this Agreement at any time we will not be prevented from doing so later.

6.6 You agree that we can send any documents or notices to you by e-mail. Any notice or demand sent to you will be deemed to have been received by you if sent by e-mail or left or sent by prepaid envelope addressed to you at your current address or last known business or private address.

6.7 You permit us to contact your employer named in your Employment Details at anytime as may be reasonably required by us.

6.8 We may transfer or assign all or any of our rights under this Agreement.

7. Jurisdiction

7.1 This agreement shall be governed by your home court.

7.2 The contractual terms and conditions, and the prior information, are in English. We undertake, with your agreement, to communicate with you in English during the duration of this Agreement.

8. Use of Your Information

8.1 It is important that you provide us with accurate information in connection with this agreement. Prior to entering into this agreement, or at the time of doing so, we may decide to check your details with fraud prevention agencies. If you provide false or inaccurate information or we suspect fraud, this information may be recorded. Fraud prevention agency records will be shared with other organisations to help make decisions on credit, motor, household, life and other insurance proposals or claims for you and members of your household.

8.2 Furthermore, prior to entering into this agreement, we may decide to search your record at credit reference agencies. They will add to their records about you, details of our search and your application and this will be seen by other organisations that make searches. Our search of records at credit reference agencies may be linked to your spouse/partner or other persons with whom you are linked financially. For the purposes of any application or this Agreement you may be treated as financially linked and you will be assessed with reference to "associated records".

8.3 We may also add to your record with the credit reference agencies details of your agreement with us, the payments you make under it and any default or failure to keep to its terms. These records will be shared with other organisations and may be used and searched by us, and others, in order to:
a) Consider applications for credit and credit related services, such as insurance, for you and any associated person;
b) Trace debtors;
c) Recover debts;
d) Prevent or detect money laundering and fraud; and
e) To manage your accounts.

8.4 If you fail to keep up repayments under the Agreement we may send your personal details, including name and contact details and details about your payment history under the agreement, to third party debt collection agencies so that they may collect the money that you owe under this agreement.

8.5 If you require details of the credit reference agencies or any other agencies from whom we obtain, and to whom we pass, information about you please write to us at our address stated above. You have a legal right to these details. You have the right to receive a copy of the information we hold about you if you apply to us in writing.

8.6 All communication between you and us will be recorded. All calls between you and us are recorded for training and monitoring purposes and to service the Agreement.

9. Complaints

9.2 Upon receipt, we will aknowledge receipt of the complaint via email and will investigate your complaint and give a response within 5 working days of receiving the complaint. We may consider giving you redress if unintended inconveniences have been caused to you by us.

9.3 If you are not happy with our final response, you have a right to have your complaint dealt with under the Financial Services Ombudsman Scheme, The Financial Ombudsman Service

3. Costs of the credit

Related costs
Costs in the case of late payments. If you are late in repaying an advance the following charges apply (for each advance). 4. Other important legal aspects

Right of withdrawal.
You have the right to withdraw from this agreement before the end of 14 days beginning with the day after the day on which the agreement is made.
Early repayment. You have the right to repay the credit early in full at any time.
Consultation with a Credit Reference Agency. If we decide not to proceed with a prospective regulated consumer credit agreement on the basis of information from a credit reference agency we must, when informing you of this decision, inform you that the decision has been reached on the basis of information from a credit reference agency and inform you of the particulars of that agency.
Right to a draft Loan Agreement. You have the right, upon request, to obtain a copy of the draft Loan Agreement free of charge, unless we are unwilling at the time of the request to proceed to the conclusion of the Loan Agreement.
The period of time during which the creditor is bound by the pre-contractual information. We are only bound by this information on the day that it is provided to you.

In addition to personal and financial information, we may collect information about your computer including your IP address, operating system and browser type. We may pass your personal information to our agents and service providers so that they may use your information on our behalf for the purposes described in this Policy and they may pass information held by them about you to us so that we may do the same.

Credit reference agencies

Credit reference agencies (CRAs) are used by lenders to assess loan applications and verify customers' identity to prevent crime and money laundering. We use the information you have given us during the application to search your records from CRAs. We do this on every loan application.
We may also, make periodic searches at CRAs in order to refresh our records and manage your account with us. Information on applications will be sent to CRAs and will be recorded by them. When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders. They supply to us both public (including the electoral register) and shared credit and fraud prevention information. Where you borrow from us, we will give details of your account(s) and how you manage it/them to CRAs. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs to perform similar checks and to trace your whereabouts and recover debts that you owe. Records remain on file for 6 years after they are closed, whether settled by you or defaulted. You can contact the CRAs currently operating in the UK to get information on your credit file; the information they hold may not be the same so it is worth contacting them all. They will charge you a statutory fee for the provision of information.

Fraud Prevention

We take fraud prevention very seriously. If inaccurate or false information is provided, including in relation to a person's identity and fraud is suspected or identified, details about this information, including customer Personal Data, will be passed to fraud prevention agencies. Law enforcement agencies may access and use this information. About CPA

About CPA

Continuous payment authority or CPA is an automatic payment set up using your debit card. We use CPA to collect loan payments. Continuous payment authorities are covered by the Payment Services Regulations 2009. These regulations set out how payment service providers should operate payment systems.

How we use CPA

3 days before your scheduled due date we will send you an email and a text message informing you that we will collect the payment on your due date using your registered debit card. If the repayment fails on your due date we will make another attempt to collect the sum owed within 30 days after your scheduled payment date. We will not make more than 2 collection attempts per repayment unless you give us express consent.

Cancelling your CPA

You can cancel your CPA at any time using any of the methods below. Remember that cancelling your CPA does not terminate your Loan Agreement and you must arrange for another way to pay us.

Cancelling CPA via email

Please send an email to info@creditstar.co.uk with the subject “Cancel CPA” In the email please quote at least one of the following to help us identify your account

  • your loan agreement number;
  • your mobile phone number;
  • your email;

Please note that it may take up to 12 hours to process this instruction.

Cancelling CPA over the phone

You can also cancel CPA by calling us on 02036957544 within our opening hours.

Cancelling by contacting your bank

You can cancel CPA by contacting your bank. If you do so please pass on your loan agreement number to them. Please note that cancelling CPA by contacting your bank can take several days. We kindly ask you to inform us if you have instructed your bank to cancel CPA.

Our loans are intended for short-term use only and are not suitable for long term borrowing. We take a meticulous approach in assessing each loan application and reserve the right to decline any application irrespective of any previous history you may have had with our company.

We have made every effort to make our service transparent: we do not have any hidden fees, all of the information and costs are available on our website so that you can decide whether our service is suitable for you.
