2. Key features of the credit product

3. Costs of the credit

The rates of interest which apply to the Loan Agreement The normal rate of interest is per annum. This interest rate is fixed. Daily interest rate is of the principal.
Annual Percentage Rate of Charge (APR).
This is the total cost expressed as an annual percentage of the total amount of credit.
The APR is there to help you compare different offers.

Related costs
Costs in the case of late payments. If you are late in repaying an advance the following charges apply (for each advance). These charges may be varied by us on giving you seven days' notice. 3 days after your first missed repayment date – default charge £15. Interest will accrue on the outstanding amount at a rate of per day, starting from the first day the payment is overdue until you have repaid in full. The total cost is capped at 100% of the loan amount.

If you have still not paid 65 days after the repayment date the account is transferred to a debt collection agency. You have to pay any other costs that we reasonably incur as a result of you missing your payments, for example our reasonable legal costs or the additional costs incurred by a debt collection agency.

If you are late in repaying the advance we will charge you interest at the applicable interest rate for that advance on the amount of the advance until it is repaid in full.
Consequences of missing payments. If you miss your repayments:
- this may make it more difficult to obtain credit in the future
- we may not provide you with future advances;
- we may take legal proceedings against you
- we may make an adverse entry against you with credit reference agencies

4. Other important legal aspects

Right of withdrawal.
You have the right to withdraw from this agreement before the end of 14 days beginning with the day after the day on which the agreement is made.
Early repayment. You have the right to repay the credit early in full at any time.
Consultation with a Credit Reference Agency. If we decide not to proceed with a prospective regulated consumer credit agreement on the basis of information from a credit reference agency we must, when informing you of this decision, inform you that the decision has been reached on the basis of information from a credit reference agency and inform you of the particulars of that agency.
Right to a draft Loan Agreement. You have the right, upon request, to obtain a copy of the draft Loan Agreement free of charge, unless we are unwilling at the time of the request to proceed to the conclusion of the Loan Agreement.
The period of time during which the creditor is bound by the pre-contractual information. We are only bound by this information on the day that it is provided to you.

We only collect details that we need to assess your application and service the loan, we also collect data we receive from Credit Reference Agencies. We do not usually process “special category” data unless you provide us with such data. This data may include your medical information which you may provide us, or which may become known to us if provided by a third party representing you under your authorisation. Where we do process such data, it is done in accordance with this policy.

We collect any other information which you may provide us when communicating with us via e-mail, telephone or post. We collect data about the way you manage your account with us for analytical purposes and to improve our services. To combat fraud and to ensure a high quality of service we record e-mails, chats and phone calls

Why do we collect and use your personal information

We collect and use your personal information in order for us to assess your creditworthiness and affordability to make a lending decision on your loan application.

We collect and use your personal information to administer the loan agreement that you enter into with us.

We use your information to verify the accuracy of the data you give us, to prevent fraud, to trace and recover debts and to contact you about your account with us.

We also use your information to undertake research, to analyse and assess our services and to improve them.

We will use your personal information to send future marketing communication to you by email, telephone, text and post in relation to similar products and services that may be of interest to you. It is to be noted that we will not market products to you by telephone if you subsequently register your telephone number with the Telephone Preference Service or by post if you register your postal address with the Mail Preference Service. Each marketing communication will contain simple instructions on how to unsubscribe/opt-out from future marketing and you can also change your preferences on your user account.

Who will we share your personal information with

We will share your personal information with third parties such as HMRC and the FCA where we are required to do so by law. We also share your data with Credit Reference Agencies and debt collection agencies. We also share data with Third Parties who help manage our systems and deliver our service (for example IT service providers). We have signed confidentiality agreements with them and they can only use the data we share with them to provide us with the services.

Credit Reference Agencies

Credit reference agencies (CRAs) are used by lenders to assess loan applications and verify customers’ identity to prevent crime and money laundering. We use the information you have given us during the application to search your records from CRAs. We do this on every loan application to ensure we comply with responsible lending practices, to support collections and tracing and to comply with regulatory requirements and obligations.

We may also, make periodic searches at CRAs in order to refresh our records and manage your account with us. Information on applications will be sent to CRAs and will be recorded by them. When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders. They supply to us both public (including the electoral register) and shared credit and fraud prevention information. Where you borrow from us, we will give details of your account(s) and how you manage it/them to CRAs. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs to perform similar checks and to trace your whereabouts and recover debts that you owe. Records remain on file for 6 years after they are closed, whether settled by you or defaulted. You can contact the CRAs currently operating in the UK to get information on your credit file; the information they hold may not be the same so it is worth contacting them all. They may charge you a statutory fee for the provision of information.

The identities of the CRAs, their role also as fraud prevention agencies, the data they hold, the ways in which they use and share personal information, data retention periods and your data protection rights with the CRAs are explained in more detail at CRAIN. How long will we store your personal information

We will store your personal information for up to six years from when you apply with us or finish paying off your loan. This is to enable us to refer to our records in the unlikely event that you want to lodge a complaint against us within six years and to ensure we comply with anti-money laundering and fraud regulations.

We will store your personal information for a longer period of time for the sole purposes of sending you marketing communications about products and/or services that may be of interest to you. Each marketing communication will give you an easy way to opt-out of receiving any further marketing communications. Where we store your personal information beyond the six year period for marketing purposes we will only store your contact details.

Where is your data stored

We recognise the need for appropriate protection and management of the personal and financial information you share with us. We protect that information using secure socket layer (SSL) encryption technology and by limiting employee access on a need-to-know basis. We employ firewalls and other security technologies to protect our servers from external attack.

Our security systems meet or exceed industry standards and we are constantly monitoring internet developments to ensure our systems evolve as required. We also test our systems regularly to make sure our security mechanisms are up to date.

We are subject to UK and EU data protection laws, which we comply with fully and give the greatest respect. We do not store your data outside the EU however if we do so in the future it will be done in accordance with this policy and with the highest protections to your privacy.

TThe Annual Percentage Rate or in short – APR, is the interest payable on the loan amount and other charges expressed as an annual rate charge. APR assumes the rate of charge for a whole year and expresses interest and other fees as an annual rate. All lenders have to tell you what their APR is before you sign a regulated consumer credit agreement.
In addition to the APR, you should also look at the total amount payable on your repayment date and make sure that you can afford the repayment. Remember that APR shows the annual percentage rate, Creditstar provides loans for a much shorter period than a year and this why you should also look at the total amount payable when making a decision on whether to apply for a Creditstar loan or not.

About CPA

About CPA

Continuous payment authority or CPA is an automatic payment set up using your debit card. We use CPA to collect loan payments. Continuous payment authorities are covered by the Payment Services Regulations 2009. These regulations set out how payment service providers should operate payment systems.

How we use CPA

3 days before your scheduled due date we will send you an email and a text message informing you that we will collect the payment on your due date using your registered debit card. If the repayment fails on your due date we will make another attempt to collect the sum owed within 30 days after your scheduled payment date. We will not make more than 2 collection attempts per repayment unless you give us express consent.

Cancelling your CPA

You can cancel your CPA at any time using any of the methods below. Remember that cancelling your CPA does not terminate your Loan Agreement and you must arrange for another way to pay us.

Cancelling CPA via email

Please send an email to info@creditstar.co.uk with the subject “Cancel CPA” In the email please quote at least one of the following to help us identify your account

  • your loan agreement number;
  • your mobile phone number;
  • your email;

Please note that it may take up to 12 hours to process this instruction.

Cancelling CPA over the phone

You can also cancel CPA by calling us on 02036957544 within our opening hours.

Cancelling by contacting your bank

You can cancel CPA by contacting your bank. If you do so please pass on your loan agreement number to them. Please note that cancelling CPA by contacting your bank can take several days. We kindly ask you to inform us if you have instructed your bank to cancel CPA.

Complaints Policy

You have the right to file a complaint if you are not satisfied with our service. If you wish to file a complaint we require it to be sent in written form via e-mail or post with your account details.

We handle every complaint individually and every complaint is reviewed by a senior manager who will investigate and respond within 5 working days of receiving the complaint. We will inform you if the investigation will take longer.

If you are not satisfied with our response you have the right to refer the case to the Financial Ombudsman Service within 6 months of receiving our final response.

Our loans are intended for short-term use only and are not suitable for long term borrowing. We take a meticulous approach in assessing each loan application and reserve the right to decline any application irrespective of any previous history you may have had with our company.

Please consider carefully before applying for any form of credit. We have made every effort to make our service transparent: we do not have any hidden fees, all of the information and costs are available on our website so that you can decide whether our service is suitable for you. We will consider customers who are:

  • able to repay the loan on the agreed date

We only offer our services to customers who are at least 18 years old, employed and who pass our credit and fraud checks and who we believe have the means to pay back on time.

When reviewing an application we will check the details you have provided us and perform a credit check via credit reference agencies. If your application is approved, you need to keep a promise to pay back the advance on the agreed date.

We understand that sometimes circumstances can change. If you are having problems paying back a loan, please don't hesitate to contact us. We will work with you to find a mutually beneficial solution.

Our charges are capped at 0.80% interest per day, the default charge cap is £15 and the total cost cap is 100%.
